When OMV Rejects Your SR-22 Filing

You paid for SR-22 insurance, the carrier confirmed they filed it with the Louisiana Office of Motor Vehicles, and two weeks later OMV still shows your license as suspended. The carrier says the filing went through. OMV says they never received it, or they rejected it for a data mismatch. You're stuck between two systems that don't communicate, and your reinstatement clock isn't running.

Filing assistance is not the same as filing acceptance. When a Louisiana carrier offers 'SR-22 filing assistance,' they mean they will transmit your SR-22 certificate to OMV electronically. They do not guarantee OMV will accept it. OMV rejects filings for address mismatches between your driver's license record and the policy, for lapses in payment status that trigger auto-cancellation before OMV processes the filing, and for missing data fields the carrier's system didn't populate. The carrier filed. OMV rejected. You don't find out until you check your OMV record weeks later.

Filing assistance means the carrier transmits your SR-22 to OMV. It does not mean OMV will accept it.

Louisiana SR-22 Filing Period

Louisiana requires continuous SR-22 proof of financial responsibility for three years from the date OMV accepts the filing, not the date your carrier submits it. If OMV rejects the initial filing and you refile two weeks later, your three-year clock starts from the second acceptance date.

What Filing Assistance Actually Covers

Filing assistance means the carrier completes the SR-22 certificate form, transmits it to OMV through the state's electronic filing system, and monitors for confirmation that OMV received the transmission. It does not mean the carrier verifies your OMV address matches your policy address before filing. It does not mean they check whether your payment cleared before the filing window closed. It does not mean they will notify you if OMV rejects the filing.

Most carriers charge a one-time SR-22 filing fee set by the carrier. Louisiana does not impose a state SR-22 filing fee. The carrier fee covers the administrative cost of preparing and transmitting the certificate. If OMV rejects the filing and you need to refile, some carriers charge the filing fee again. Others waive it if the rejection was due to carrier error. The fee structure varies by carrier and is not regulated by OMV.

The carrier's filing obligation ends when OMV confirms receipt of the transmission. After that point, OMV either accepts the filing and updates your driver record, or rejects it and sends a notice to the address on file. If your address is wrong, you won't receive the rejection notice. If you don't check your OMV record online, you won't know the filing failed until your reinstatement hearing or your next traffic stop.

OMV does not notify your carrier when they reject an SR-22 filing. The rejection notice goes to the driver's address on file, and if that address is outdated, you never receive it.

How to Verify OMV Accepted Your Filing

Log into your OMV account at omv.dps.louisiana.gov within 5 business days of your carrier's filing confirmation. Navigate to your driver record and check the SR-22 status field. If it shows 'SR-22 on file' with a start date matching your carrier's filing date, OMV accepted the filing. If it shows 'no SR-22 on file' or a different start date, OMV either rejected the filing or has not processed it yet. Call OMV's reinstatement unit at the number listed on the OMV contact page to confirm rejection reason and required corrections.

If OMV rejected the filing for an address mismatch, update your address with OMV first, then ask your carrier to refile. If OMV rejected it for a payment lapse, confirm your policy is active and paid current, then request a new filing. If OMV rejected it for missing data fields, ask your carrier to resubmit with complete information. Each rejection and refile cycle adds 5-10 business days to your reinstatement timeline, and your three-year SR-22 clock does not start until OMV accepts a clean filing.

Why Filings Fail After Carrier Confirmation

The most common rejection cause is address mismatch. Your OMV driver's license record shows your old address. Your SR-22 policy shows your current address. OMV's system flags the mismatch as a data integrity error and rejects the filing. The carrier has no visibility into your OMV address record, so they can't catch this before filing. You must update your OMV address before the carrier files, or OMV will reject it.

The second most common cause is payment lapse between policy effective date and OMV processing date. You buy the policy on the 1st. The carrier files the SR-22 on the 2nd. Your payment bounces on the 5th. The carrier auto-cancels the policy on the 6th and files an SR-26 cancellation notice with OMV. OMV processes your SR-22 filing on the 8th, sees the SR-26 already on file, and rejects the SR-22 as invalid. The carrier filed correctly. The payment failure invalidated it before OMV accepted it.

Missing data fields are less common but harder to fix. Some carriers' SR-22 systems don't populate the OMV-required fields for suspension case number or court order number when those fields apply to your suspension type. OMV rejects the filing as incomplete. The carrier must update their system template and refile. This can take weeks if the carrier's SR-22 team doesn't prioritize Louisiana-specific field requirements.

Carriers That Handle Louisiana SR-22 Filings

Seven carriers write SR-22 policies in Louisiana and file directly with OMV: Geico, Progressive, State Farm, Bristol West, Direct Auto, National General, and The General. Geico, Progressive, and State Farm file through their standard-tier underwriting divisions and accept DUI, uninsured motorist, and points-accumulation suspension triggers. Bristol West, Direct Auto, National General, and The General specialize in non-standard SR-22 business and typically quote lower premiums for DUI and multiple-violation suspensions than the standard carriers.

Filing speed varies by carrier. Geico and Progressive file electronically within 1-2 business days of policy binding. State Farm files within 2-3 business days. Bristol West, Direct Auto, National General, and The General file within 3-5 business days. All seven carriers monitor OMV's electronic filing system for receipt confirmation, but only Geico and Progressive proactively notify you if OMV rejects the filing. The other five expect you to check your OMV record yourself or call their SR-22 department for status updates.

What to Do When Your Filing Is Rejected

Call OMV's reinstatement unit immediately and ask for the specific rejection reason. OMV will tell you whether the rejection was due to address mismatch, payment lapse, missing data, or another cause. Write down the rejection code and the name of the OMV representative you spoke with. Call your carrier's SR-22 department with that information and ask them to confirm they can refile once you correct the underlying issue.

If the rejection was due to address mismatch, update your address with OMV online or in person before asking your carrier to refile. If it was due to payment lapse, confirm your current policy is active and paid through at least the next 30 days, then request the refile. If it was due to missing data fields, ask your carrier whether they can populate the required fields or whether you need to switch to a carrier whose system handles Louisiana-specific OMV requirements. Do not wait for the carrier to discover the rejection on their own. Most won't check unless you ask.
